toxic chemicals and was diagnosed with prostate cancer, says the

ANDERSON COUNTY, TX: Martinez Files Renewed Bid for Class Cert.

In the class action lawsuit captioned as CRISTIAN MARTINEZ and PAUL
ESTRADA, individually and on behalf of all others similarly
situated, v. ANDERSON COUNTY; KARINA GARCIA, in her official
capacity as ANDERSON COUNTY BOND SUPERVISION OFFICER, Case No.
6:22-cv-00171-JCB-KNM (E.D. Tex.), the Plaintiff files renewed
motion for class certification.

The Plaintiffs Estrada and Perkins seek to certify four classes.

  1. Main Damages Class

     "All persons who are or have been on pre-trial bond
     supervision in Anderson County and charged bond supervision
     and/or urinalysis fees;"

  2. Indigent Damages Subclass

     "All indigent persons who are or have been on pre-trial
     bond supervision in Anderson County and charged bond
     supervision and/or urinalysis fees;"

  3. Main Injunctive Class

     "All persons who are or will be on pre-trial bond
     supervision in Anderson County and charged bond supervision
     and/or urinalysis fees;"

  4. Indigent Injunctive Subclass

     "All persons who are or have been on pre-trial bond
     supervision in Anderson County and charged bond supervision
     and/or urinalysis fees."

This case challenges the Defendant Anderson County's collection of
pre-trial fees from individuals not convicted of any crime. As
standard operating procedure, Defendant Garcia collects $50 per
month in bond supervision fees on behalf of Anderson County from
arrestees released on bail before trial -- without considering
ability to pay or offering a waiver for individuals unable to pay.

The Defendant Garcia also charges urinalysis fees without
considering ability to pay and employs questionnaires that violate
individuals' privacy rights.

On behalf of all others subjected to bond supervision in Anderson
County, the Plaintiffs Paul Estrada and Edward Leroy Perkins 1 seek
class certification to challenge the bond fees, urinalysis fees,
and questionnaires.

Because these pre-trial fees are charged uniformly as a matter of
county policy, common -- not individual -- issues of fact and law,
evidence, and relief, abound, the lawsuit says.

Elevance Health Inc. disclosed in its Form 10-K, filed with the
Securities and Exchange Commission on July 20, 2022, that it is a
defendant in a class action lawsuit that was initially filed in
June 2016 against Elevance Health (formerly Anthem, Inc.) and
Express Scripts, which has been consolidated into a single
multi-district lawsuit captioned "In Re Express Scripts/Anthem
ERISA Litigation," in the U.S. District Court for the Southern
District of New York. The case has been dismissed.

The consolidated complaint was filed by plaintiffs against Express
Scripts and the company on behalf of all persons who are
participants in or beneficiaries of any Employee Retirement Income
Security Act of 1974 (ERISA) or non-ERISA healthcare plan from
December 1, 2009 to December 31, 2019 in which the company provided
prescription drug benefits through the Express Scripts (a pharmacy
benefit management company) Agreement and paid a percentage based
co-insurance payment in the course of using that prescription drug
benefit.

The plaintiffs allege that the company breached its duties, either
under ERISA or with respect to the implied covenant of good faith
and fair dealing implied in the health plans, by failing to
adequately monitor Express Scripts' pricing under the ESI PBM
Agreement, by placing its own pecuniary interest above the best
interests of insureds by allegedly agreeing to higher pricing in
the ESI PBM Agreement in exchange for the purchase price for its
NextRx PBM business, and with respect to the non-ERISA members, by
negotiating and entering into the ESI PBM Agreement that was
allegedly detrimental to the interests of such non-ERISA members.

Plaintiffs seek to hold the company and Express Scripts jointly and
severally liable and to recover all losses suffered by the proposed
class, equitable relief, disgorgement of alleged ill-gotten gains,
injunctive relief, attorney's fees and costs and interest.

In April 2017, the company filed a motion to dismiss the claims and
was granted, without prejudice, in January 2018. Plaintiffs pursued
an appeal with the United States Court of Appeals for the Second
Circuit. In December 2020, the Second Circuit affirmed the trial
court's order dismissing the ERISA complaint. Plaintiffs filed a
Petition for Rehearing and Rehearing En Banc, which was denied.
Plaintiffs filed a writ of certiorari with the United States
Supreme Court. In December 2021, the United States Supreme Court
requested that the Solicitor General submit a brief "expressing the
views of the United States" as to whether the court should grant
plaintiffs' writ. In May 2022, the Solicitor General recommended
that the United States Supreme Court deny plaintiffs' writ. In June
2022, the United States Supreme Court declined plaintiffs' writ of
certiorari.

THREE ARROWS CAPITAL: Got $2.36-Bil. in Loans From Genesis
----------------------------------------------------------
Jose Rodrigo of Benzinga Crypto reports that a division of the
cryptocurrency lender owned by Digital Currency Group (DCG),
Genesis Asia Pacific Pte Ltd., provided $2.36 billion in loans to
the defunct hedge firm 3AC.

The precise amount of the debt has not previously been disclosed,
despite earlier reports claiming Genesis faced a potential
nine-figure loss as a result of its exposure to 3AC.

The arbitration procedure seemed to have been put on hold by
Genesis after the consultancy firm Teneo was selected to supervise
the liquidation of 3AC in late June.  On July 1, 3AC submitted a
Chapter 15 bankruptcy petition in New York.

According to a DCG representative, both the DCG and Genesis balance
sheets are still solid. Genesis is well-capitalized and conducting
business as usual with no further exposure to 3AC.

Teneo, the company chosen last month to handle 3AC's liquidation,
posted a 1,157-page court document online on Monday that contained
information about the 3AC debts.

In a letter Genesis sent to the American Arbitration Association on
June 15, the company stated 3AC had broken two financing agreements
signed in January 2019 and January 2020.

The company's loans to 3AC had a weighted average margin demand of
more than 80%, which 3AC had not been able to fulfill, leading
Genesis to liquidate its collateral, according to a series of
tweets from Genesis CEO Michael Moro on July 6, 2022. He said that
in order to have the funds "to operate and scale" its company
moving ahead, DCG had accepted some Genesis obligations.

As a result, a source with knowledge of the situation claims that
DCG is now more vulnerable to possible losses associated with 3AC's
borrowing than Genesis.

               About Three Arrows Capital

Three Arrows Capital Ltd. was an investment firm engaged in
short-term opportunities trading, and is heavily invested in
cryptocurrency, funded through borrowings.

As of April 2022, the Debtor was reported to have over $3 billion
of assets under its management.

Three Arrows Capital Ltd. was incorporated as a business company
under the laws of the British Virgin Islands.  Its sole shareholder
owning all of its "management shares" is Three Arrows Capital Pte.
Ltd., which previously operated as a regulated fund manager in
Singapore until 2021, when it shifted its domicile to the BVI, as
part of a global corporate plan to relocate operations to Dubai.

The Debtor borrowed digital and fiat currency from multiple lenders
to fund its cryptocurrency investments.   After cryptocurrency lost
99% of its value, and then prices of other cryptocurrencies had
rapid declines, the Debtor reportedly defaulted on its
obligations.

On June 24, 2022, one of the Debtor's many creditors -- DRB Panama
Inc.  -- filed an application to appoint joint provisional
liquidators -- and thereafter, full Liquidators -- in the Eastern
Caribbean Supreme Court in the High Court of Justice (Commercial
Division) located in BVI. The application was assigned claim number
BVIHCOM2022/0117.

Subsequently, on June 27, 2022, the Debtor filed its own
application for the appointment of joint liquidators before the BVI
Commercial Court.

On June 29, 2022, the Honorable Mr. Justice Jack of the BVI
Commercial Court appointed Russell Crumpler and Christopher Farmer
of Teneo (BVI) Limited as joint liquidators of Three Arrows Capital
Ltd.

On July 1, 2022, liquidators of Three Arrows Capital filed a
Chapter 15 bankruptcy in the U.S. (Bankr. S.D.N.Y. Case No.
22-10920) to seek recognition of the BVI proceedings.  Judge Martin
Glenn is the case judge.  Latham & Watkins, led by Adam J. Goldberg
is counsel in the U.S. case.

The law firm of Ogier, led by Grant Carroll, is advising the
liquidators in the BVI proceedings.

TWO CARING: Fails to Properly Pay Caregivers, Meade Suit Alleges

ALEXIA MEADE, on behalf of herself and all others similarly
situated, Plaintiff v. TWO CARING HANDS PRIVATE HOME CARE, LLC and
YOLANDA SHAW, Defendants, Case No. 1:22-cv-02763-TWT (N.D. Ga.,
July 14, 2022) is a class action against the Defendants for failure
to compensate the Plaintiff and similarly situated employees
overtime pay for all hours worked in excess of 40 hours in a
workweek in violation of the Fair Labor Standards Act.

The Plaintiff was employed by the Defendants as a personal care
assistant/caregiver.

UNITED STATES: Court Denies Bid to Certify Class as Moot
--------------------------------------------------------
In the class action lawsuit captioned RICH ELBERT, JEFF A. KOSEK,
REICHMANN LAND & CATTLE LLP, LUDOWESE A.E. INC., and MICHAEL
STAMER, individually and on behalf of a class of similarly situated
persons, v. UNITED STATES DEPARTMENT OF AGRICULTURE, RISK
MANAGEMENT AGENCY, and FEDERAL CROP INSURANCE CORPORATION, Case No.
0:18-cv-01574-JRT-TNL (D. Minn.), the Hon. Judge John R. Tunheim
entered an order that:

   1. The Plaintiffs' motion to certify a class is denied as
       moot; and

   2. The approval of the amendment to Section 3(c)(2) Dry Bean
      Revenue Endorsement as applied to dark red kidney beans in
      Minnesota for crop year 2015 is vacated and remanded to
      the Federal Crop Insurance Corporation for reconsideration
      consistent with this opinion.

The Court said,"The Plaintiffs seek class-wide reformation of the
2015 policy contracts. Because their Motion for Class
Certification is predicated on a form of relief the Court will not
grant for now, the Court will also deny Plaintiffs' motion without
prejudice as moot."

The Plaintiffs, dark red kidney bean farmers from Minnesota,
purchased revenue insurance coverage -- the Dry Bean Revenue
Endorsement (“Endorsement”) -- to protect against a decline in
bean prices as measured by the difference between the spring
projected price and the fall harvest price. In 2015, such a decline
occurred. There was also insufficient published pricing data to
establish a harvest price under the Endorsement's default harvest
pricing method.

The harvest price was then set as equal to the projected price per
the contingency pricing terms of the Endorsement. The Plaintiffs,
therefore, received no compensation.

The Plaintiffs brought claims under the Administrative Procedure
Act (APA) against Defendants -- the United States Department of
Agriculture, the Risk Management Agency, and the Federal Crop
Insurance Corporation -- arguing that it was arbitrary and
capricious for Defendants to allow the Endorsement to convert their
revenue coverage into yield protection. The parties then filed
cross motions for summary judgment.

The United States Department of Agriculture is the federal
executive department responsible for developing and executing
federal laws related to farming, forestry, rural economic
development, and food.

ZEN BODY MECHANICS: Maddy Files ADA Suit in S.D. New York

A class action lawsuit has been filed against Zen Body Mechanics,
LLC. The case is styled as Veronica Maddy, on behalf of herself and
all others similarly situated v. Zen Body Mechanics, LLC, Case No.
1:22-cv-05980-MKV (S.D.N.Y., July 13, 2022).

The lawsuit is brought over alleged violation of the Americans with
Disabilities Act.
