(16.2%) on November 14, 2017, to close at $3.00 per share. Heath

Bank's ADRs declined from a close of $16.69 on February 3, 2016
to a close of $14.89 on February 4, 2016, an 11% drop that wiped

ORANGE COUNTY, CA: Court Refuses to Certify Class in "B.R." Suit
------------------------------------------------------------
The Hon. Cormac J. Carney denied the Plaintiff's motion for class
certification in the lawsuit captioned B.R., a minor, and all
others similarly situated, by and through his Guardian ad litem,
JILL RANDALL v. COUNTY OF ORANGE, MYESHIA HAMMOND, together with
all similarly situated, Case No. 8:15-cv-00626-CJC-PJW (C.D.
Cal.).

Plaintiff B.R., a minor, on behalf of himself and all others
similarly situated, brings this civil rights class action against
the Defendants in connection with the County's alleged
warrantless removals of children from their parent's custody.
The Plaintiff brings this action on behalf of himself and a
putative class of "[a]ll natural persons, who, as minors, were
seized from their parents or legal guardians' care and/or
custody, without a removal warrant, by the County of Orange from
April 20, 1994 through December 31, 2013, and where the primary
removal reason in the CWS/CMS database is 'neglect.'"

In his order, Judge Carney opines that the Plaintiff's proposed
class in his motion is different than what he proposed in the
Complaint.  The Plaintiff originally defined the class as "[a]ll
natural persons who, as minors, were seized from the care and
custody of their parents by Orange County without prior judicial
authorization and in the absence of an immediate threat of
grievous bodily injury."

"When Plaintiff decided to change the definition of the proposed
class that he would seek certification for, he should have sought
leave from this Court to file a First Amended Complaint that
contained a precise definition for his new proposed class.  It is
Plaintiff's burden, not this Court's, to propose a class that
merits certification.  However, even if the Court granted
Plaintiff leave to amend and he filed a First Amended Complaint
containing a definition of the proposed class he now seeks to
certify in his motion, the Court could not grant certification.
The class Plaintiff now seeks to certify fails to meet the Rule
23 requirements," Judge Carney explains.

Judge Carney also states that proceeding as a class is not
superior to other methods of resolving the issues presented by
this case.  "Given the individualized issues, adjudicating the
claim at issue here on an individual basis would be more
efficient, particularly given the lack of commonality," Judge
Carney continues.

RUSHMORE LOAN: Putative Class Claims in "Sellers" Suit Tossed

The Hon. Timothy J. Corrigan entered an order in the lawsuit
entitled RANDOLPH SELLERS, individually and on behalf of a class
of persons similarly situated and TABETHA SELLERS, individually
and on behalf of a class of persons similarly situated v.
RUSHMORE LOAN MANAGEMENT SERVICES, LLC, Case No. 3:15-cv-01106-
TJC-PDB (M.D. Fla.):

   (1) denying Rushmore Loan Management Services, LLC's Motion
       for Reconsideration of Ruling on Summary Judgment;

   (2) denying the Plaintiffs' Renewed Motion for Class
       Certification;

   (3) dismissing with prejudice the putative class claims;

   (4) directing the parties to file a joint case management
       report by January 12, 2018.  The Court will enter a case
       management scheduling order for the remainder of the case.

The Plaintiffs filed the lawsuit on Sept. 11, 2015, raising
claims under the Fair Debt Collection Practices Act, the Florida
Consumer Collection Practices Act and the Declaratory Judgment
Act, based on their receipt of numerous communications from
Rushmore.

On March 30, 2017, the Court held a hearing on Rushmore's motion
for summary judgment.  The Court granted Rushmore's motion as to
Count III, which involved Plaintiffs' receipt of one Request for
Taxpayer Identification Number, but otherwise denied the motion.
Therefore, Plaintiffs' claims that Rushmore violated the FDCPA
and the FCCPA by sending them several mortgage statements in an
attempt to collect a debt previously discharged in bankruptcy
remain.

On May 16, 2017, Rushmore filed a motion for reconsideration,
asking that the Court review its denial of summary judgment as to
Counts I, II, and IV in light of recent Eleventh Circuit
authority.  Plaintiffs filed a response in opposition.

On June 1, 2017, Plaintiffs renewed their motion for class
certification, requesting that the Court certify the following
class:

     All Florida consumers who (1) have or had a residential
     mortgage loan serviced by Rushmore Loan Management Services,
     LLC, which Rushmore obtained when the loan was in default;
     (2) received a Chapter 7 discharge of their personal
     liability on the mortgage debt; and (3) were sent a mortgage
     statement dated September 11, 2013 or later, in
     substantially the same form as Mortgage Statement I and/or
     Mortgage Statement II, and was mailed to the debtor's home
     address in connection with the discharged mortgage debt.

Rushmore opposes Plaintiffs' motion for class certification on
all possible grounds, including that the proposed class is not
ascertainable; Plaintiffs fail to meet any of the requirements of
Rule 23(a), Fed. R. Civ.  P.; and they fail to satisfy the
predominance and superiority requirements of Rule 23(b), Fed. R.
Civ. P. (Doc. 61).

Rushmore requests that the Court reconsider its order denying
summary judgment on Plaintiffs' FDCPA and FCCPA claims as to
Mortgage Statements I and II in light of a recent Eleventh
Circuit decision in Helman v. Bank of America, No. 15-13672, 2017
WL 1350728 (11th Cir. Apr. 12, 2017) (unpublished).

In the Dec. 12, 2017 Order, Judge Corrigan opines that if the
Court certified the Plaintiffs' proposed class, such
individualized inquiries would be required for every class member
to determine whether the Section 524(j) exception to the
Bankruptcy Code discharge injunction applied, and if so, whether
the Bankruptcy Code precluded and/or preempted the FDCPA and
FCCPA.

Such a course of action -- which Plaintiffs' proposed class
definition mandates -- is the type of extensive individualized
factual inquiry that is too burdensome to allow class
certification, Judge Corrigan states.

CSC is the largest provider of coin-operated laundry machines to
commercial and residential clients in the United States.

Kay-Kay is a real estate management company that owns and manages
multi-unit apartment buildings throughout New Mexico, Arizona,
Oklahoma, and Wisconsin.

Kay-Kay entered into various long-term contracts with CSC agents.
Under its contracts, Kay-Kay leased its laundry rooms to Coinmach
and Mac-Grey so that they could install their laundry machines
and collect money from their use.  On or around May 2017, CSC
sent a letter to Kay-Kay announcing that it will begin deducting
a 9.75% "administrative fee" from its laundry machines' gross
collections, amount to approximately $0.10 per machine per day.
Kay-Kay never agreed to an administrative fee and did not agree
to or sign any amendments to its contracts, or otherwise
