ATLAS TRANSIT: "Cordova" Suit Alleges Violations of FLSA, NYLL

RENE CORDOVA, individually and on behalf of all others similarly
situated, Plaintiff, against ATLAS TRANSIT MIX CORP., and VINCENT

The Honorable Joan H. Lefkow entered an order in the lawsuit
titled Stoyan Stoyanov, the Plaintiff, v. Bluestone Law, LTD, the

Center. The Plaintiff received the 5/2/2016 Letter in the ordinary
course. The 5/2/2016 Letter top left side reads, "RE: Partnership
Community Health Center." The first paragraph of the 5/2/2016
Letter goes on to state, "This letter shall serve to
inform you that your delinquent account has been placed with
Professional Placement Services, LLC." The 5/2/2016 Letter fails
to identify who "placed" the delinquent account with PPS. The
third paragraph of the 5/2/2016 Letter states, in relevant part,
"If you request this office in writing within 30 days after
receiving this notice, this office will provide you with the
name and address of the original creditor, if different from the
current creditor."

The 5/2/2016 Letter fails to identify the name of the creditor to
whom the debt is owed. By failing to identify the name of the
creditor, PPS leaves the unsophisticated consumer in doubt about
to whom their alleged debt is owed and if it is legitimate.

SERVIS ONE: Court Denies Bid for Class Certification in "McCamis"

In the lawsuit entitled RONNIE J. McCAMIS, the Plaintiff, v.
SERVIS ONE, INC., d/b/a BSI FINANCIAL SERVICES, INCORPORATED, the
Defendant, Case No. 8:16-cv-01130-JSM-AEP (M.D, Fla.), the Hon.
James S. Moody entered an order denying Plaintiff's motion for
class certification.  The proposed class was defined as:

"all individuals who: (1) filed a Chapter 7 or Chapter 13
  bankruptcy in the Middle District of Florida, (2) surrendered
  their home in the bankruptcy proceedings, (3) obtained a
  discharge, and (4) after they received the discharge, received
  communications related to the discharged mortgage from or on
  behalf of Servis One, Inc., d/b/a BSI Financial Services, Inc.,
  on or after May 6, 2014."

The class action relates to Defendant's alleged practice of
attempting to collect a discharged debt directly from a debtor
after Defendant was informed that the debt was discharged in
bankruptcy. Specifically, Plaintiff Ronnie J. McCamis alleges that
in February 2015, he filed a Chapter 7 bankruptcy petition in the
United States Bankruptcy Court for the Middle District of Florida,
in Case No. 8:15-bk-01271-CPM (Bankr. M.D. Fla.). The Plaintiff
listed in his bankruptcy petition a mortgage on real property,
provided notice in his bankruptcy case that he intended to
surrender the property, and vacated the property. The Plaintiff
received a discharge in bankruptcy that extinguished his personal
liability on the mortgage debt in May 2015.

Judge Moody held, among other things, that certification is
inappropriate because Plaintiff has failed to establish that
common issues predominate over individual issues.

In the lawsuit styled Karen RODRIGUEZ, et al., individually and
On behalf of other similarly situated persons, the Plaintiffs, v.

Case No. 0:16-cv-60442-JIC (S.D. Fla.), the Hon. James I. Cohn
entered an order granting Plaintiffs' unopposed motion for
preliminary approval of settlement, certification of class and
appointment of class Representatives and class counsel.

For the purposes of the Settlement only, the Court preliminarily
certifies the Class defined as:

   "all current and former customers of Defendant who insured
   real property with Defendant between September 1, 2013, and
   March 31, 2016".

For the avoidance of doubt, two individuals who jointly insure
real property shall both be Class Members even if only one of the
individuals holds a mortgage or appears on documents evidencing
ownership of the real property. The Class shall exclude Defendant,
its past or current officers, directors, affiliates, legal
representatives, predecessors, successors, assigns and entities in
which any of them have a controlling interest.
For the avoidance of doubt, also excluded are Universal Parent and
Atlas and any entity in which any of them have a controlling
interest, either directly or indirectly. The Class also excludes
all judicial officers assigned to this case, and their immediate
families. The Class shall also exclude persons who affirmatively,
validly, and timely exclude themselves from the Class pursuant to
the procedures described in the Notice.

The Court further held that Plaintiffs are certified as the class
representatives, and Kaplan Fox & Kilsheimer LLP is appointed lead
class counsel.
