Plaintiff was hired as a reach operator, which meant he was

CAREGIVERS FOR INDEPENDENCE: Lee Moves to Certify Workers Class
---------------------------------------------------------------
The Plaintiff in the case captioned titled BOBBI LEE, individually
and on behalf of all others similarly situated v. CAREGIVERS FOR
INDEPENDENCE, LLC, et al., Case No. 1:16-cv-00946-MRB (S.D. Ohio),
moves the Court to conditionally certify the case as a Fair Labor
Standards Act collective action and to approve notice.

The proposed class is defined to include:

All current and former group healthcare workers employed by
Caregivers for Independence, LLC, James Couch, Phyllis "Sue"
Couch and James Couch, II, and/or any of its or their
affiliated entities who were not paid overtime for all hours
worked over 40 in a work week since September 23, 2013.

Bobbi Lee and other similarly situated employees (FLSA Collective
Members) were employed by the Defendants -- Caregivers for
Independence, LLC, James Couch, Phyllis "Sue" Couch, and James
Couch, II -- as healthcare workers to provide care for elderly,
ill or disabled clients in group homes owned or operated by the
Defendants.  The lawsuit challenges the Defendants' alleged common
policy of not paying healthcare workers overtime for all hours
over 40 worked in a workweek.

ES MEDICAL: Mussat's Bid to Certify Granted; Hearing on Jan. 11
---------------------------------------------------------------
The Hon. Ronald A. Guzman grants the Plaintiff's motion for class
certification filed in the lawsuit titled Florence Mussat, M.D.
S.C., individually and on behalf of similarly situated persons v.
E.S. Medical Equipment and Supplies, Case No. 1:16-cv-01240 (N.D.
Ill.).

Judge Guzman said that he is satisfied that the class is
ascertainable based on this (amended) definition:

All persons and entities who were successfully sent a fax
[on X date(s)] in the form of Exhibit A, advertising
products available at www.esmedical.com "offering 2
discounts on all products for all of 2016."

The Court ordered the Plaintiff to file an amended class
definition, consistent with the Order, within 14 days.  A status
hearing is set for January 11, 2017, at 9:30 a.m.

The Case is a putative "junk fax" class action under the Telephone
Consumer Protection Act.  The Plaintiff claims that she and other
similarly-situated doctors and doctors' offices were sent
unsolicited fax advertisements from the Defendant.  Those faxes,
moreover, did not contain an "opt-out" notice as required by the
TCPA, she asserts.

ETERNITY FLOORS: Sued in Cal. Super. Ct. Over Laminate Flooring
---------------------------------------------------------------
CHRISTOPHER SANTIAGO, and JULIA SANTIAGO, individually, on behalf
of themselves and all others similarly situated, the Plaintiffs,
v. ETERNITY FLOORS d/b/a L.A. HARDWOOD FLOORING, INC., a
California Corporation; CAMILO MONTEALEGRE, an individual; and
DOES 1-50, inclusive, the Defendant, Case No. BC644600 (Cal.
Super. Ct., Dec. 21, 2016), seeks order of the Court requiring
Defendants to disgorge all ill-gotten gains and awarding
Plaintiffs and the Class full restitution of all monies wrongfully
acquired by Defendants.

The case is about breach of warranty, fraudulent
omission/concealment, and state statutory class action on behalf
of all persons in California who purchased Chinese-made laminate
flooring distributed and sold under the Eternity Floors brand
name. The Defendants designed, manufactured, distributed and sold
Chinese-manufactured laminate flooring (the "Flooring") that
failed to meet certain advertised industry standards, including
the California Air Resources Board (CARB) regulations concerning
formaldehyde emissions, and the "AC" durability rating.

Laminate flooring is considered in the industry as a commodity
product, in the sense that its construction is relatively uniform
across brands and models, with each seller competing largely on
the basis of price.

Eternity Flooring is a leading manufacturer and distributor of
laminate flooring in the industry.

FLEETONE LLC: Swinter Group Seeks Class Certification Under TCPA
----------------------------------------------------------------
The Plaintiff in the lawsuit entitled SWINTER GROUP, INC. v.
FLEETONE, L.L.C., Case No. 4:16-cv-01464-JAR (E.D. Mo.), asks the
Court certify as a class its claims against the Defendant for
alleged violation of the Telephone Consumer Protection Act of
1991, as amended by the Junk Fax Prevention Act of 2005.

Swinter Group also moves to stay briefing and ruling on its Motion
until completion of discovery and upon further order of the Court.
The Plaintiff asks that the Motion be held in abeyance in order to
avoid granting the Defendant a strategic advantage, allowing the
Defendant to make an offer of judgment under Rule 68 of the
Federal Rules of Civil Procedure, a common, but now discredited
strategy by defendants to "pick off" named plaintiffs when no
motion for class certification has been granted.

MCDONALD'S CORPORATION: Faces "Killeen" Suit Over Value Meal

2016-CH-16519 (Ill. Cir. Ct., December 22, 2016), seeks to redress

improper advertising, sales and marketing practices that
McDonald's continues to engage in regarding certain of its Extra
Value Meals(R), including its Two Cheeseburger Extra Value Meal

MECHEL BLUESTONE: Jordan Seeks to Enforce Mediation Agreement
-------------------------------------------------------------
The Plaintiff in the lawsuit captioned DAVID JORDAN, individually
and on behalf of all others similarly situated v. MECHEL
BLUESTONE, INC., and DYNAMIC ENERGY, INC., Case No. 5:16-cv-04413
(S.D.W. Va.), files with the Court his motion to enforce mediation
agreement, enjoin ex parte settlements, certify class, and approve
limited class discovery.

Mr. Jordan noted that the defense counsel has been actively
seeking settlements on the side with individual class members
after signing a mediation agreement to settle the class action on
a class-wide basis -- a Mediation Agreement that provides more
damages per capita than what the Defendants have proposed in the
side-agreements.  He asserts that a number of the class members
with whom the Defendants have solicited side agreements are, upon
information and belief, still currently employed by the
Defendants.

The Defendant's actions, Mr. Jordan contends, are causing members
of the agreed-upon class to be pressured by their employer to
settle for a discount value and are also depriving those members
of adequate notice to opt out of the class after full written
notice of the settlement is reached in the matter.  Accordingly,
in order to avoid prejudice to the class, he moves for the Court
to enforce the Mediation Agreement regarding class settlement that
was reached by Magistrate Omar J. Aboulhosn, that the Court
certify the proceeding as a class action against the Defendants,
and that the Court order a limited period of 30 days for class
discovery so that the size of the common fund may be ascertained.

The Mediation Agreement, which the Parties reached on December 5,
2016, with the assistance of Magistrate Aboulhosn, settles all
class matters except for the question of the number of class
members and the amount of the reasonable attorney fee.  The key
terms of the Mediation Agreement include the Defendants' agreement
to pay to each member of the class the sum of $10,250, inclusive
of attorneys' fees and costs.  The Defendants agree to pay to
class counsel an administrative fee of $30,000 to administer the
settlement.  The Defendants also agree to pay to David Jordan a
class representative fee of $15,000.
